Who is it for?

BDNS has been designed for use by the organs in article 36 of the implementing measures of the General Subsidies Act (Ley 38/2003) of 17 November 2003:

  1. The following organs are required to provide information on the subsidies they award:
    1. Central Government
    2. Entities making up Local Government
    3. The governments of the Autonomous Communities
    4. Public authorities and other public-law institutions having their own legal personality and tied to or dependent on any of the public authorities, where the subsidies they award are in exercise of administrative powers
    5. Consortia, associations of municipalities or other public organisations created by various public authorities and agencies or entities dependent upon the latter, where the subsidies they award are in exercise of administrative powers.
  2. The following shall be required to supply information on monetary payments made without consideration:
    • Public authorities and other public-law institutions having their own legal personality and tied to or dependent on any of the public authorities that are governed by private law.
    • Consortia, associations of municipalities or other public organisations created by various public authorities and agencies or entities dependent upon the latter that are governed by private law.
    • Public-sector foundations.
  3. The obligation to supply information also applies to the organs that issue the final decisions referred to in article 13.2, paragraphs c) and h) of the Subsidies Act, reporting the information identifying the organisation unable to obtain the status of beneficiary or partner entity and the period for which it is unable to obtain such status. The Government Comptroller's Office will sign agreements with organs that issue the final decisions referred to in article 13.2) of the Act in order to provide information on the data identifying the organisation unable to obtain the status of beneficiary or partner entity and the period for which it is unable to obtain such status, under article 47.3 of the aforementioned Act.
  4. Notwithstanding paragraphs 1 and 2 above, for regional and local government, the information will be supplied to the database through the organs listed below:
    • The General Comptroller of the Autonomous Community or organ designated by the Autonomous Community.
    • The Comptroller or organ designated by the Local Authority.
